Sponsorship and compliance

Skills in Demand visa (subclass 482) & Sponsor Compliance

For roles that are ongoing, sponsorship done properly — and sponsor obligations managed.

Where a role is ongoing rather than time-bound, the pathway is employer sponsorship, becoming an approved sponsor, nominating the position, and carrying sponsor obligations. Resource Visa advises Australian resources and energy employers across sponsorship approval, the Subclass 482 Skills in Demand visa, labour agreements, ongoing compliance and permanent residence planning.

Employer sponsorship pathways

Sponsorship

From skills gap to sponsored specialist.

Standard business sponsorship, nomination and visa applications under the subclass 482 (Skills in Demand) program, prepared end-to-end: labour market testing integrated with your recruitment workflow, salary benchmarking against the income thresholds, and nomination submissions built on the same commercial business-case discipline as our 400 work — including the harder cases, like converting a role whose 400 history the Department will examine.

The subclass 482 Skills in Demand visa has three streams: Specialist Skills, Core Skills and Labour Agreement. The Specialist Skills stream is open to most occupations where the salary meets its income threshold. It isn’t available for technicians and trades workers, machinery operators and drivers, or labourers, whatever the salary.

From 400 to 482

When short-term turns ongoing.

If the role turns out to be ongoing, the 482 is a fresh application with its own sponsorship and nomination. A 400 may carry a ‘No Further Stay’ condition. If it does, the specialist can’t apply for the 482 while in Australia unless the Department first waives the condition. A waiver is discretionary, so the 482 may need to be lodged from outside Australia. We manage the conversion properly — a sponsorship and nomination case that explains the history and establishes the ongoing role on its merits.

Sponsor compliance

Sponsorship is a licence with obligations attached.

Sponsor obligations don’t manage themselves. Sponsor obligations start when you’re approved, and some continue after the sponsorship ends. They include giving equivalent terms and conditions, keeping records, telling the Department about certain changes within 28 days, paying reasonable return travel costs if asked, and cooperating with inspectors. Breaches can lead to sanctions, including bars on sponsoring, cancellation, infringement notices, civil penalties and enforceable undertakings.

Sponsorship and nomination charges, the Skilling Australians Fund levy and recruitment costs sit with the sponsor. Australian law prohibits passing them to the sponsored worker, directly or through deductions or bonds.

The Migration Act now provides for a public register of approved work sponsors. It can show sponsor names, ABNs, the number of nominations and the occupations nominated.

Resource Visa manages sponsor compliance on retainer: obligation monitoring, and the notifications and lodgements that follow each workforce change you tell us about. The obligations stay with your business in law. On a retainer we manage them with you, but we can’t take them over.

Sponsor Compliance Check

Already sponsoring under the 482 or a DAMA? Start with a Sponsor Compliance Check: a structured conversation about your sponsorship position, followed by a one-page note of the gaps we discussed. No fee for the initial check. Any further work is quoted in writing before it starts. Before we meet, we’ll send you the Consumer Guide published by the Office of the Migration Agents Registration Authority.

Labour-hire desk

The outsourced migration & compliance desk.

Labour-hire and on-hire sponsors carry obligations at a scale in-house teams often weren’t built for. The compliance desk manages the whole function on retainer — monitoring and lodgement management — so your consultants place people.

The sponsor is the business that employs the worker, or an associated entity. A standard business sponsor generally can’t place a sponsored worker under an unrelated host’s control; on-hire arrangements need a labour agreement. Sending your own sponsored technician to work on a client’s site, under your supervision, isn’t on-hire.

DAMA

DAMA and labour agreements.

A Designated Area Migration Agreement (DAMA) lets an employer in a designated area sponsor occupations, with concessions, that the standard 482 doesn’t offer. The employer first needs endorsement from the region’s Designated Area Representative, then its own labour agreement with the Australian Government.

Who we are

Migration advice with a finance background

Resource Visa is a Perth migration practice for resources employers. Immigration assistance is provided by a Registered Migration Agent (MARN 1686595), and your briefing is with a registered agent, not an intake team. Our principal came to migration from corporate finance, so the commercial case behind a mobilisation doesn’t have to be explained to us.
