The terms "Resource Visa Australia", "us", "our", or "we" refer to Resource Visa Australia PTY LTD, the owner and operator of this website. The terms "Client" or "you" refer to any user of the website and/or purchaser of services offered through this platform.

1. Website & Operator

These Terms and Conditions govern your use of the website resourcevisa.com.au and all services provided through it.

This website is operated by Resource Visa Australia PTY LTD, an Australian-registered company. By accessing or using this website, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. Acceptance may also be indicated by clicking to agree via the website interface.

Resource Visa Australia provides advisory services on Australian visas and immigration. All visa-related consulting and application services are delivered by Registered Migration Agents, who operate under the Code of Conduct for Migration Agents. Both the Code of Conduct and Consumer Guide are accessible on this website.

Content provided on this website is for informational purposes only and does not constitute legal advice. While efforts are made to maintain accuracy, we cannot guarantee completeness or precision of the information.

2. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any dispute arising from these Terms shall be interpreted in accordance with Victorian laws, regardless of conflict of law rules. These Terms shall apply to and be binding upon the parties and their respective successors and assigns.

3. Visa Quick Assessment

Our Visa Quick Assessment tool is a complimentary online questionnaire designed to provide a preliminary indication of possible visa options based on your responses. However, the tool does not replace comprehensive consultation and should not be relied upon as a final assessment.

The assessment does not establish a consultant-client relationship, nor does it guarantee visa approval. Only the Department of Home Affairs can make decisions regarding visa applications.

Information submitted during the assessment will be used solely to process your request and initiate further contact.

4. Initial Visa Consultation

We offer initial visa consultations through this website. You will receive a Statement of Service before confirming your purchase, and again via email.

The accuracy of advice provided is reliant on the information you submit. We are not responsible for inaccuracies resulting from incorrect or incomplete data provided by you.

Cancellations or rescheduling of appointments must be requested at least 24 hours in advance via email. Cancellations made within 24 hours are non-refundable.

5. Visa Services

You may purchase the following visa services directly through our website:

  1. eVisitor Visa (651)
  2. Working Holiday Visa (417)
  3. Resident Return Visa (155)

Each service comes with a Statement of Service outlining the terms prior to purchase and via email.

Our role is to prepare and submit applications in alignment with current Australian immigration policies and regulations. We provide strategic guidance for submitting complete and timely applications. However, application success depends entirely on the decision of Australian immigration authorities.

Clients must personally provide all necessary information and documentation and inform us of any changes in circumstances. False information or documents are serious offenses and may result in application refusal or visa cancellation.

We do not guarantee visa grant outcomes. Even with approval, Australian authorities retain the right to cancel a visa or refuse entry. Resource Visa Australia bears no liability in such cases.

Once a visa is granted or refused, our contractual obligations for that application are considered fulfilled. Appeals or further legal actions fall outside our scope unless otherwise agreed.

Resident Return Visa (155)

Our online service for this visa is limited to clients who meet residency requirements and have no criminal record. If these conditions are not met, Resource Visa Australia may offer a revised fee structure or terminate the agreement. In the case of termination, the refund terms outlined in Section 6 apply.

The client authorizes Resource Visa Australia to verify visa status via VEVO using passport details. If ineligible, the service is limited to advice, and a reduced service fee of $150 will apply, with any excess refunded.

Working Holiday Visa (417)

Clients may use our Australian mailing address to apply for a Tax File Number (TFN). If you choose this option, you consent to us opening and scanning TFN-related mail from the ATO, which will be emailed to you. Original letters will be destroyed after three months. This address may not be used for any purpose other than TFN correspondence. Resource Visa Australia is not liable for lost or misdirected mail due to incorrect postal details.

6. Fees, Payment & Termination

Payment options include:

  1. Credit/Debit Card
  2. PayPal (via PayPal Australia Pty Limited)

Payments are processed through PayPal and Stripe. By using these methods, you agree to their respective terms and conditions.

Fees and disbursements are held in a client account until they are due:

  1. Consultation fees are charged after service completion.
  2. Disbursements are withdrawn after payments are made to third parties.
  3. Visa service fees are withdrawn upon application lodgement.

Initial consultation fees are non-refundable if the client cancels. If an appointment is not scheduled within four weeks of purchase, the service is considered complete and non-refundable.

Refund Policy:

  1. No refund is available once we begin preparing your visa application.
  2. If preparation has not commenced, a refund is issued minus an A$100 admin fee (not exceeding the total service fee paid).
  3. If the client cancels before lodgement, any included government visa fee will be refunded, minus bank charges.

We reserve the right to terminate the contract if:

  1. You breach or intend to breach any part of these Terms.
  2. You fail to provide timely responses or necessary documentation.
  3. You submit false or fraudulent information.

If there is no client response for over four weeks despite follow-up, Resource Visa Australia may consider the matter closed and retain full fees
